A federal criminal trial against Huawei Technologies opened in Brooklyn, New York, with federal prosecutors accusing the Chinese firm of operating as a criminal enterprise.
During opening statements, Department of Justice attorney Taylor Stout alleged that Huawei engaged in a decades-long pattern of trade secret theft, financial deception, and racketeering to gain an unfair global advantage.
Prosecutors contend that Huawei stole proprietary technology from multiple American firms, including Cisco Systems router source code and a T-Mobile robotic smartphone-testing device.
The government further alleged that Huawei concealed business operations in Iran to bypass U.S. sanctions, unlawfully moving millions of dollars through American financial institutions and assisting local authorities with domestic surveillance.
Defense Argues Lawful Competition
Defense attorney Brian Heberlig rejected the racketeering charges, describing Huawei’s global expansion as the result of legitimate innovation and ordinary commercial competition. The defense argued that the prosecution is cherry-picking isolated incidents to manufacture an overarching conspiracy.
Regarding intellectual property disputes with Cisco and T-Mobile, the defense characterized them as unauthorized actions by rogue employees that were addressed internally by management. Addressing the sanctions claims, the defense maintained that Huawei did not intentionally violate banking regulations, noting that international financial partners were aware of the firm’s commercial footprint in Iran.
International Context and Legal Background
The legal proceedings originated from a 2018 indictment that led to the detention of Huawei Chief Financial Officer Meng Wanzhou in Canada. Meng resolved her personal charges in 2022 under a deferred prosecution agreement, though her factual statements will serve as evidence during this proceeding.
In response to the courtroom developments, China’s Foreign Ministry stated that it firmly opposes U.S. suppression of Chinese companies and supports domestic enterprises defending their lawful rights.
Huawei’s networking hardware remains restricted across the United States, and domestic suppliers must obtain Commerce Department licenses to export sensitive technology to the company. The federal trial is anticipated to last roughly three months.
